Part 2: Those who Marry with the Intention of Divorce Question and Answer ‘She wants to Marry to make Umrah with the intention of divorce on Return’.

All the praise is for Allah the Most High and peace and blessings be upon our beloved Prophet Muhammad, and his family and all his Companions.

Those who marry a person with the intention of divorce. This is something I still find Muslims in America practicing even those who proclaim to follow the Sunnah and even those who further to say they follow the Minhaj of the asSalaf asSalih.

 

Those who marry a person with the intention of divorcing such as the one who marries for temporary marriage (Muta Marriage), or a woman marries to make Umrah or Hajj on their return divorce, or to stay in a country (green card or visa), or the one who marries a woman who married before and is forbid to return to that ex-husband he marries with the intention to divorce her so she can return to that previous spouse.

Concerning those single sisters who want to make Hajj or Umrah and marry a person to have a Mahram (1.) with the intention of divorce on returning. Those who marry for the purpose of having a lawful Mahram this is not lawful for it is temporary marriage which is unlawful.

I asked my teacher Shaykh Dr. Hasan Abdul Gafaar al Bashir may Allah preserve him, Question & Answer:

سؤال: السلام عليكم و رحمة الله و بركاته. عندي سؤال تجد المراة المسلمة هي ستعمر العمرة باطفالها لكن حكام في المملكة العربية السعودية لا يؤتيها اقامة لاطفالها سبب هي ليست زوجًا فهي الثيب و الفردة. الان هي تريد ان تتزوج رجلًا بنية طلاق بعد ترجع من العمرة ما حكم عليها و هل العمرة لها صحيحة؟ بارك الله فيكم

الاجبة: وعليكم السلام ورحمة الله وبركاته ، الجواب أن العمرة صحيحة والسفر محرم ، فتصح العمرة بالقياس على من سافرت بدون محرم وعملت عملا مباحا فالسفر محرم والعمرة صحيحة وبالقياس أيضا على من صلى في ارض مغصوبة فالغصب محرم والصلاة صحيحة.

Q: Assalamu alaykum wa rahamtullahi wa barakatuhu. I have a question, there is present a Muslim woman she will make Umrah with her children but the government of KSA does not give her a visa for her children because she is not married and she is a woman who is not married and she is single. Now she wants to marry a man with the intention of divorce after she returns. What is the ruling on her, is her Umrah correct? Baraka Allahu Feekum.


A: Wa alaykum salam wa rahamtullahi wa barakatuhu, the answer is that Umrah is correct traveling is prohibited (because without a mahram correct mahram due to invalid marriage contract because of intention to divorce).  So the Umrah is correct with qiyas ( Islamic juristic analogy) she traveled without a Muhram, she did an action that is permissible (Umrah), so her travel was prohibited and the Umrah is correct and also with qiyas whoever prays in a land that is was seized by force (stolen) the seizing by force is prohibited and salah is correct (praying in that place is correct even though it was seized by force).
