All praise is for Allah the Most High and peace and blessings be upon our beloved Prophet Muhammad, and his family and all his Companions.

 

Concerning what follows:

Those who marry a person with the intention of divorce. This is something I still find Muslims in America practicing even those who proclaim to follow the Sunnah and even those who further to say they follow the Minhaj of the asSalaf asSalih.


Those who marry a person with the intention of divorcing such as the one who marries for temporary marriage (Muta Marriage), or a woman marries to make Umra or Hajj on their return divorce, or to stay in a country (green card or visa), or the one who marries a woman who married before and is forbid to return to that ex-husband he marries with the intention to divorce her so she can return to that previous spouse.


So those who marry a person with the intention of divorce. Even if it is not written in the contract divorce after the such and such time period, but if it is one of the intentions of his or her heart it is invalid the written contract and the marriage.


ٍShaykh Salih al Uthaymeen may Allah have mercy upon him said related to the one who marries with the intention of divorce to remain in a country ( such as for visa or green card and what similar to that):

 

لو نوى زوج “المتعة” بدون شرط يعني: نوى الزوج بقلبه أن يتزوج هذه المرأة لمدة شهر، ما دام في هذا البلد فقط، فهل نقول إن هذا حكمه حكم المتعة أم لا؟ في هذا خلاف، فمنهم من قال ” إنه في حكم نكاح المتعة” لأنه نوى وقد قال النبي صلى الله عليه وسلم ” إنما الأعمال بالنيات وإنما لكل امرئ ما نوى” رواه البخاري (1/11) . مسلم (13/53).

“If he intended marriage without the condition (divorce): meaning he (or she) intended to marry with the intention in his heart that he is marrying this woman for the period of a month (then divorce) as long he remains in this country only.So do we say that this is the ruling of tempory marriage or not? In this is the difference from them ( the scholars) who say ” Indeed upon him is the ruling of tempory marriage because he intends (tempory) indeed the Prophet sallahu wa alayhi wa salam said: all actions are base upon intentions and upon any person, it is based upon what he intends.” Narrated by al Bukharee and Muslim. “


Then it is said in the book of marriage explanation of Zad almustaqnae tape number 9:

 

فإذا تزوج الرجل على هذه النية فعلى قول من يقول إنه من “نكاح المتعة” ، -وهو المذهب- فالنكاح باطل . وعلى القول الثاني – وهو الذي نختاره – أن النكاح صحيح ، لكنه آثم بذلك من أجل الغش ، وهو مثل ما لو باع الإنسان سلعة – بالشروط المعتبرة شرعا – لكنه غاش فيها: فالبيع صحيح، والغش محرم. أ.هـ. من ” شريط رقم 9 – كتاب النكاح” . شرح “زاد المستقنع”.

“So when the man marries upon this intention (of divorce) there is a statement that says this is from temporal marriage and – this is a mathab- so this marriage is false (invalid).
There is another statement: it is – we choose it – and this marriage is correct, but it is sinful and it is for the purpose of pettifoggery (dishonest thing, cheating), and such as a person who sells a product with the condition set in the Shariah but has some defect (in the product) he cheats by that, so the selling is correct but cheating is muharam (prohibited/ impermissible) “
