Q: What is the condition of the repentance from the person who offers Rishwa (bribery), and if his repentance is sincere, is it to be accepted? Along with the wealth, that was involved with this bribery and indeed you took this bribery offered? May your eminence be rewarded.


A: Bribery, the nature of it, and its gain are filthy. Cursed are those who implies it, and cursed are those who take it, and cursed are those who seek it out (spreads it). Cursed is he who use it as a means to intermediate with it (negotiate). This is in an authentic hadeeth:

” Allah cursed the briber, the one who takes the bribe, and the bribe it self (wealth or money that was involved)”

And he who conveys (spreads ) it between them two, all of them are cursed, and wretched (cursed) is ruled on the action, that it is a major crime, and it’s severe from the major of sins. So he takes bribery it’s something major from the major of sins, and he who has fallen into bribery it is obligatory upon him repentance from bribery (in all forms describe the one who offers it, the one who accept it, and the wealth). Whatever is the wealth which was taken from bribery it is obligatory that he free himself from that wealth, with that he gives it to those who are poor and the needy. That is from the door of freeing from the wealth from bribery, and not from the door (direction) of charity (sadiqah, because sadiqah from lawful wealth that one get rewards from) but it’s like wealth that is lost, which he does not own, and he puts it as a means of conciliation (to be used for good but he do not receive a reward from it). In general, he uses it as to support those who have a need and those who are poor and needy, along with him is his repentance to Allah Glorified is He free from all imperfections and the Most High.

السؤال:
كيفية التوبة من دفع الرشوة، وهل تقبل التوبة اذا كانت خالصة، وأيضا المال ماذا أعمل به، وقد أخذت من هذه الرشوة مأجورين؟
الجواب: الرشوة، سحت وكسب خبيث، ملعون من دفعها، وملعون من أخذها، وملعون من سعى فيها، وتوسط فيها وهذا في الحديث الصحيح، من قوله صلى الله عليه وسلم، (لَعَنَ اللَّهُ الرَّاشِيَ وَالْمُرْتَشِيَ وَالرَّائِشَ)، وهو ساعي بينهما، كلهم ملعونون، واللعنه تقتضي أن هذا العمل، أنه جرم كبير، وكبيره من كبائر الذنوب، فأخذ الرشوة كبيرة من كبائر الذنوب، ومن وقع فيها فإنهُ يجب عليه التوبة منها، وما عندهُ من المال الذي أخذهُ بالرشوة يجب أن يتخلص منه، بإن يضعهُ فيه الفقراء، والمساكين، على أنه من باب التخلص، لا من باب الصدقة، لكنه كالمال الضائع، الذي ليس له مالك وأنهُ يضع في المصالح، العامة ويضع بأيدي المحتاجين والفقراء والمساكين مع التوبة إلى الله سبحانه وتعالى.
